The Public Domain Enhancement Act

Public domain holds an enormous amount of free content ranging from photographs to articles. Much of this content is not copyrighted or the copyrights have expired on the material. It is for this reason that you can use the material found in the public domain for free. If you want to take some articles and use them for your own benefits, you can. The same is true for any of the other materials found in the public domain.

Many creative people have greatly benefited from the material found in public domain but at the same time, others have had their work taken when they accidentally let their copyrights expire or when they assumed that after so many years their work would simply be left in the public domain untouched. Most of the classic films and music fall into this category. Over the past four years the US congress has been working on the “Public Domain Enhancement Act” to amend the copyright laws that now exist on creative works.

One of the main concerns surrounding the “Public Domain Enhancement Act” is the section on placing a tax on the copyright holders. The tax is simply a way to determine if the person owning the copyrights to the material is still interested in keeping it. If so, they would have an opportunity to pay a small tax renewal fee to keep the material from being placed in a public domain. The original owner will have three years to pay the tax and if they have not responded by this time, it will be assumed they are no longer interested in the material.

One benefit of the changes being proposed is that it would be easier to track copyright holders and find out who owns what. It could also increase the amount of material found in public domains providing even more opportunities for the creators of today. Basically, what it all comes down to is the copyrighter will have a right to decide if their works are placed in public domain or not after the fifty year waiting period has expired.

By changing these laws, it raises a lot of questions about how the content can be used and it has both advantages and disadvantages. This is why there is still much debate on the issue and so far there has been no decisions made.

The material found in public domain will allow people to use the original works of someone else to create new and innovated material in their own name without having to get permission. When the original owner of a copyrighted piece no longer has use for the material why shouldn’t it be available to others that can use it and create new works?
